1. Introduction and Acceptance
Welcome to Future Constructor ("the Service"), accessible at https://constructor.futuremarkt.com. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
The Service is a tool only. We provide a technical interface for deploying ERC-20 token smart contracts on Ethereum Virtual Machine (EVM) compatible blockchains. You are solely responsible for all tokens you create, their use, and any legal, regulatory, or financial consequences.
2. Description of Service
Future Constructor is a no-code token creator that enables users to deploy ERC-20 token smart contracts on the following blockchain networks:
- Ethereum (mainnet)
- Polygon (mainnet)
- BNB Chain (formerly Binance Smart Chain, mainnet)
- Arbitrum (mainnet)
- Base (mainnet)
Built on OpenZeppelin Contracts v5 (v5.4.0); factory source verified on Sourcify; no independent audit. While we use industry-standard libraries, you use the Service at your own risk.
How It Works:
- Non-custodial: The Service does not hold, control, or have access to your cryptocurrency, private keys, or wallet. You interact directly with on-chain smart contracts (TokenFactory contracts) using your own wallet.
- Deployment fee: Each token deployment requires a fee paid on-chain at the time of deployment. Current fees are approximately:
- Ethereum: $6 USD equivalent
- Polygon, BNB Chain, Arbitrum, Base: $3 USD equivalent each
- Smart contract interaction: When you use the Service, you authorize a transaction from your wallet to the TokenFactory smart contract. The contract deploys your ERC-20 token on the selected blockchain. All transactions are final and irreversible.
- No custody or control: After deployment, the token is owned and controlled by the wallet address you used. We do not have access to your tokens, cannot reverse transactions, and cannot modify or delete deployed contracts.
3. User Responsibilities
3.1 Legal Compliance
You are solely responsible for:
- Determining whether creating, issuing, or distributing a token is legal in your jurisdiction.
- Complying with all applicable laws, including but not limited to securities laws, anti-money laundering (AML) regulations, know-your-customer (KYC) requirements, tax obligations, and consumer protection laws.
- Obtaining any necessary licenses, registrations, or legal opinions before creating or distributing a token.
We do not provide legal advice. The Service is a technical tool. Creating a token may constitute issuing a security or other regulated financial instrument in your jurisdiction. Consult a qualified attorney before using the Service if you are uncertain about legal requirements.
3.2 No Investment Advice
We do not provide investment, financial, or tax advice. Nothing on the Service constitutes a recommendation to create, buy, sell, or hold any token. Any content, features, or examples provided are for informational and educational purposes only.
3.3 Prohibited Uses
You agree not to use the Service to:
- Create tokens intended to defraud, deceive, or harm others (including scam tokens or fraudulent schemes).
- Violate any applicable law or regulation.
- Infringe intellectual property rights (e.g., creating tokens using trademarks, copyrighted names, or logos without authorization).
- Facilitate illegal activities, including money laundering, terrorist financing, or tax evasion.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Deploy tokens designed to manipulate markets or engage in pump-and-dump schemes.
The Service is not intended for, and may not be used by:
- Persons or entities located in, or subject to the jurisdiction of, countries or territories subject to comprehensive international sanctions.
- Persons or entities on any sanctions lists maintained by the United Nations, United States, European Union, or other applicable jurisdictions.
We reserve the right to refuse service, remove records from our database, or report suspected illegal activity to authorities.
4. Smart Contract and Blockchain Risks
4.1 Smart Contract Risk
The TokenFactory smart contracts and deployed ERC-20 token contracts are provided "as is" without warranties of any kind. While we have taken reasonable care in developing the contracts, we do not guarantee they are free from bugs, vulnerabilities, or errors.
Blockchain transactions are irreversible. Once a token is deployed, it cannot be undone. You use the Service at your own risk.
4.2 Network Risks
Blockchain networks are operated by third parties (miners, validators, node operators). We do not control these networks and are not responsible for:
- Network downtime, congestion, or delays.
- Failed transactions due to insufficient gas fees.
- Blockchain forks, upgrades, or protocol changes that may affect your token.
- Loss of funds due to errors in wallet software, phishing, or other user-side issues.
4.3 No Reversal or Support
We cannot reverse, cancel, or refund transactions. Once a token is deployed on-chain, it exists permanently on the blockchain. We do not provide technical support for tokens after deployment, including troubleshooting, bug fixes, or assistance with smart contract issues.
5. Fees and Payments
5.1 Deployment Fees
Fees are paid on-chain in the native cryptocurrency of the selected blockchain. Fees are non-refundable under any circumstances, including:
- User error (e.g., incorrect token parameters, wrong network selection).
- Failed deployment due to insufficient gas or network issues.
- Change of mind after initiating deployment.
- Regulatory or legal issues that prevent you from using the token.
5.2 Gas Fees
In addition to the Service fee, you are responsible for paying gas fees (transaction fees) required by the blockchain network. Gas fees are paid to miners/validators, not to us. Gas fees vary based on network congestion and are outside our control.
5.3 Price Conversion
Fees are denominated in USD but paid in cryptocurrency using real-time price feeds from Chainlink oracles. The actual amount of cryptocurrency charged is calculated at the moment of transaction and may differ from estimates shown in the user interface due to price volatility.
6. Data Collection and Privacy
6.1 Data We Collect
The Service collects and stores the following data:
- Blockchain data: Network selected, deployed token contract address, token parameters (name, symbol, supply, decimals), deployer wallet address, deployment timestamp.
- Analytics data: We use Yandex Metrica to collect anonymized usage analytics, including pages visited, time on site, device type, browser, and general geographic location (country/city level).
- Cookies: The Service uses cookies for analytics and site functionality. See our Privacy Policy for details.
6.2 What We Do NOT Collect
- We do not collect or store your private keys, seed phrases, or wallet passwords.
- We do not require registration, email, or personal identification to use the Service.
- We do not have access to your cryptocurrency balances or ability to control your wallet.
6.3 Privacy Policy
For full details on data collection, use, and your rights, please see our Privacy Policy available on our website.

We are not responsible for intellectual property disputes related to user-created tokens.
8. Disclaimers and Limitation of Liability

- Loss of cryptocurrency or tokens.
- Costs of substitute services.
- Regulatory fines or legal liability.
- Any damages arising from your use or inability to use the Service.

It is your responsibility to review the Terms periodically.
9.3 Modification of Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
